Prenuptial & Postnuptial Agreements

The attorneys at Mayer & Young, PC are not only skilled at drafting prenuptial and postnuptial agreements, we also understand the financial implications of your decisions and can help guide your discussion as to marital expectations of how property, finances and roles or responsibilities will be handled during your marriage.

What is a Prenuptial Agreement?

A prenuptial agreement is simply a contract that outlines the expectations between two people as they embark upon their marriage.  At Mayer & Young, PC, we see the utility in discussing both big and small issues that may arise throughout the marital partnership and making a determination as to how to handle such issues before emotions are involved.  For example, money and/or finances are one of the main reasons we see people choosing to dissolve their marriage.

A prenuptial agreement allows a couple an opportunity to discuss finances with their partner before getting married and often will bring issues to light while they are still small and manageable.

What is a Postnuptial Agreement?

A postnuptial agreement is similar in content to a prenuptial agreement, it simply occurs after the parties are married.  Often prenuptial agreements are contemplated before the wedding, but the proper steps are not taken to follow-through with drafting or signing the document.  In other cases, married couples come to us seeking advice after a big life change such as the birth of a child or receipt of an inheritance.  We also see the benefit in drafting a postnuptial agreement where one partner chooses to stay home and raise a family and he or she wants to ensure financial protection should the parties ever divorce.
